DOJ shields Garland from contempt charges, sparks controversy over Biden interview tapes

In a controversial decision, the US Department of Justice (DOJ) has declined to press charges against Attorney General Merrick Garland for contempt of Congress, following the House of Representatives’ vote to penalise him for not handing over audio tapes of President Joe Biden.

The Republican-led House voted 216-207 to recommend criminal charges against Garland, stemming from his refusal to provide interview tapes from a DOJ probe into Biden’s handling of classified documents. Despite this, the DOJ stated that Garland’s actions did not constitute a crime, citing a long-standing policy not to bring charges when ‘executive privilege’ is invoked by the president.

Assistant Attorney General Carlos Felipe Uriarte defended the decision, stating that the DOJ would not prosecute Garland for adhering to Biden’s executive privilege, which blocks access to certain executive branch information.

The decision has sparked criticism, especially given Biden’s previous invocation of executive privilege to shield tapes of his interview with Special Counsel Robert Hur. Critics argue that the DOJ’s refusal to pursue charges undermines accountability and transparency, as the tapes could potentially be used in political attack ads against Biden. Meanwhile, the decision contrasts sharply with the ongoing prosecution of former President Donald Trump, who faces charges for allegedly obstructing justice by allegedly ‘hiding’ classified documents.
