Christchurch man avoids life sentence for dog walker’s murder

Bailey Messervy, 20, has been sentenced to 17 years and six months in prison, with a minimum non-parole period of seven years, for the 2022 murder of 62-year-old Nigel Wilson at Bexley Reserve in Christchurch.

Despite the mandatory life sentence outlined in the Sentencing Act for murder, Justice Rachel Dunningham deemed a life term “manifestly unjust,” citing Messervy’s youth, impulsivity, traumatic background, and rehabilitative potential.

The jury had rejected the defense’s claim that Messervy lacked intent to kill, but the court’s decision acknowledged factors mitigating the severity of his punishment.

Wilson and Messervy became involved in an argument where Wilson called out Messervy for driving his vehicle at speed through the reserve.

The court heard Wilson shut the gates at the entrance and confronted Messervy, and the defendant stabbed him eight times, with four blows to his abdomen.

The Crown said Messervy’s associate stole Wilson’s phone following the assault, leaving him unable to call for help.

Wilson’s dog returned home without him, which raised the alarm.

  3. Okay bashing someone is bad but not unforgivable. The minute you produce a knife, as far as I’m concerned you are a scumbag of the lowest kind. So seven years for this. Probably would have gotten more if he had ripped off IRD.
