Lawyers representing Tyler Robinson have argued that a key piece of forensic evidence in the killing of conservative commentator Charlie Kirk cannot be definitively tied to the alleged murder weapon, raising questions they say warrant delaying court proceedings.
In a recent filing Robinson’s legal team stated that analysts from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) were unable to conclusively match a bullet fragment recovered from Kirk’s body to a rifle ‘discovered’ near the scene. The defence cited excerpts from an internal ATF report, which has not been publicly released, to support their request for more time before a preliminary hearing scheduled for May.
Robinson, 22, was arrested shortly after Kirk was fatally shot at an event at Utah Valley University in September 2025. Investigators linked him to a modified Mauser rifle allegedly used in the attack, and prosecutors have said his DNA was found on the weapon. They also point to messages in which Robinson reportedly detailed the crime.
Despite this, the defence maintains that the inconclusive ballistic findings, along with the presence of DNA from other individuals at the scene, require further examination.
Ballistics analysis typically allows investigators to link a bullet to a specific firearm through unique markings left during firing. Robinson’s lawyers argue that the absence of such confirmation introduces uncertainty into a case that has already drawn intense public attention and debate.

The more I watch and research it’s clear the assasination attempt at Butler was a staged event.
For those of you who have not been following this case. First off a 30.06 bullet fired from the Mauser rifle would have destroyed Kirk’s neck and left a massive exit wound. There was no exit wound.
Slow motion video shows his crucifix that was slung low on his chest under his Tee shirt splitting in two and flying over his head after what may have been a detonation of the Rode microphone that was also positioned un his chest under his shirt.
It has been conjectured that Kirk’s neck wound was the result of a piece of the exploding microphone hitting his neck. (John Aaron Bray at X has close up photos of that event).
Photos of the floor of the rental SUV that took Kirk to hospital show plastic fragments consistent with the remains of an exploded Rode microphone.
