A jury in the latest rape retrial of Harvey Weinstein has failed to reach a unanimous decision, forcing a mistrial over allegations involving aspiring actress Jessica Mann.
After roughly nine hours of deliberations across two days, jurors told the court they were hopelessly divided on the third-degree rape charge linked to an alleged 2013 assault in a Manhattan hotel.
Judge Curtis Farber officially ended proceedings after the panel indicated no progress could be made. Prosecutors will return to court next month to decide whether they will pursue a fourth trial against the disgraced former movie mogul. Mann testified Weinstein pinned her down and assaulted her, while the defence insisted the relationship was consensual.
The mistrial comes after Weinstein was separately convicted during the retrial of sexually assaulting former production assistant Miriam Haley, while being cleared over claims made by another accuser. Weinstein remains imprisoned in California on a separate 16-year sentence for rape and sexual assault convictions.
