The Colorado Supreme Court has dismissed a lawsuit against Christian baker Jack Phillips, who was sued for refusing to bake a cake for a man’s gender ‘transition reveal’.
The lawsuit was filed by attorney Autumn Scardina in 2017 after Phillips, owner of Masterpiece Cakeshop in Lakewood, Colorado, declined to bake a pink and blue cake to mark Scardina’s transition.
In a 6-3 ruling on Tuesday, the justices dismissed the case, stating that Scardina had not pursued all available legal options before filing the suit with the state’s highest court.
The ruling did not address Phillips’s free speech claims.
Scardina’s attorney said he was disappointed with the ruling and would consider an appeal, while Phillips’s lawyer welcomed the decision, saying his client has faced legal battles for over a decade.
Phillips maintains that his refusal was based on the message of the cake, which conflicted with his religious beliefs, not Scardina’s gender identity.
