The jury in US man Daniel Penny’s trial remains deadlocked on the top charge of second-degree manslaughter, as deliberations entered their fourth day.
Penny, a 26-year-old Marine veteran, is accused of recklessly causing the death of Jordan Neely, a homeless man with schizophrenia who threatened passengers during a psychotic episode on a Manhattan subway.
The jury requested clarification on legal definitions, including what constitutes a “reasonable” person, as they consider whether Penny’s actions—restraining Neely in a chokehold—were justified or criminally reckless.
If found guilty of manslaughter, Penny faces up to 15 years in prison.
