HelloFresh pleads guilty to misleading customers in ‘subscription trap’ scheme

HelloFresh New Zealand has pleaded guilty to five charges of misleading conduct under the Fair Trading Act, admitting in Auckland District Court that it misled former customers into unintentionally reactivating meal-kit subscriptions during cold calls.

The charges, laid by the Commerce Commission, relate to conduct between February 2022 and July 2023, where discount vouchers were offered without clearly disclosing they would trigger automatic payments.

The Commission received numerous complaints and warned against deceptive subscription practices. HelloFresh will be sentenced in October, with both parties to submit sentencing documents ahead of the hearing.
