The New Zealand Ministry of Health recently published an interim update to its “Pandemic Plan”, bringing attention to oppressive measures that could be enforced in the event of another “health emergency.”
The update, part of a broader pandemic preparedness review following the COVID-19 experience, has ignited widespread criticism over the extensive powers granted to health and government authorities during pandemic situations.
The New Zealand Pandemic Plan, originally formulated to combat influenza and similar respiratory pathogens, has now been adapted to address any future pandemic threats. It integrates recent health system reforms and lessons learned from the COVID-19 response. However, it is the statutory powers outlined in this plan that have drawn significant international attention over the last week.
Health Act 1956
The Health Act 1956 remains the cornerstone of the country’s public health legislation, conferring significant authority to “medical officers” of health. These officers can:
- Enter premises, conduct medical examinations, detain individuals for isolation, and mandate contact tracing.
- Under authorisation, enforce quarantine, prescribe preventive treatments, requisition premises and vehicles, and close educational institutions. These powers can be activated by the Minister of Health or under an epidemic notice by the Prime Minister.
Epidemic Preparedness Act 2006
This act empowers the Prime Minister to issue “epidemic notices”, activating special powers for managing disease outbreaks.
Civil Defence Emergency Management Act 2002
In “severe situations”, the Civil Defence Emergency Management Act can be invoked, allowing authorities to regulate traffic, provide essential services, and evacuate premises.
International Health Regulations 2005
As a WHO member state, New Zealand is required to adhere to these regulations, which mandate reporting and response measures for public health emergencies of international concern. The Public Health Agency within the Ministry of Health serves as New Zealand’s National Focal Point for coordination with the WHO.
Mandated Measures
The plan outlines several mandated measures that could be imposed during a pandemic. These include requirements for people to be tested, screened, or vaccinated, which may also apply to arrivals in New Zealand. Authorities may quarantine or isolate individuals who are “potentially” exposed or infected, either in designated facilities or at home, and may restrict their movement to prevent the spread of disease. Travel restrictions, both within and outside of New Zealand, could be enforced to limit transmission.
Other measures include imposing duties on individuals to supply information for risk assessment or contact tracing, such as travel plans or past travel history. Preventive treatments may be mandated, and individuals could be required to avoid work or public places unless certain conditions are met. Authorities might also commandeer resources, such as land, buildings, or vehicles, to support the pandemic response. Any mandated actions, particularly those restricting basic freedoms, would need a system for seeking and issuing exemptions transparently and promptly, the report says.
Mandated and forced ‘vaccination’
Most controversially, the plan envisages situations where people may be mandated to undergo testing, screening or injection with mRNA gene therapies (marketed to the public as ‘vaccines’), or undergo any other form of “preventive treatment”.
Vaccine mandates were implemented by the Labour government in 2021, but the Ministry of Health’ s July review has brought the draconian nature of government power back into the spotlight, as it is not a question of “if” but “when” the next “global health emergency” will emerge.
Such measures would likely come under the category of “special powers” in the Health Act, exercisable by the Director-General of Health at a national level, or by “local medical officers of health” at a regional level, acting under the direction of the Director-General.
Section 71A of the Health Act authorises police to use force “to help” an authorised health officer exercise his or her powers, which includes requiring persons to remain in a designated place until they have undergone “preventive treatment”. Critics argue this power permits police to assist in the forced ‘vaccination’ of persons against their will. At the very least it will allow health officers to use coercive measures, and the police to use physical force, to detain a person until they have undergone “preventive treatment”.
The term “preventive treatment” is not defined in the Health Act, but is stated as any treatment the health officer “may prescribe”.
Of further concern is the plan’s declaration that coercive measures need only be formulated in statute to avoid the requirements of the Bill of Rights Act, apparently dismissing any inquiry into whether those measures are “reasonable and justified limits” under section 5 of that Act.
Reaction
The global reaction to the recent review has been overwhelmingly negative, with critics denouncing the plan as overly draconian and a threat to personal freedoms. Key figures and commentators have expressed alarm over the scope of governmental powers:

Freedom campaigner Napoleon Busch has warned of impending coercion, suggesting the measures could lead to forced vaccinations and detentions.

Concerns have also been raised about the potential for these measures to be misused, with former Australian MP Craig Kelly advising travellers to New Zealand to be aware of the stringent laws that could lead to forcible medical treatments.

Government’s Stance
The Ministry of Health maintains that the updated plan is essential for ensuring the country is “prepared for future pandemics.” The interim update is intended to reflect changes in the health system post-2022 reforms and incorporate early COVID-19 lessons.
Director-General of Health Diana Sarfati highlighted the importance of a coordinated response across all levels of government and society to minimise the impact of pandemics on public health and the economy.

It really helps to see other peoples comments so much, and yes I’ve been angered too, to the point of thinking as Rupert has said, it wouldn’t take much to take them down with me if they forced a death by vaccine.
I’m tired and angry and pleased all at the same time too so I’ve just read the jist of the report and will re read again later. As I said before I have to find a way to navigate around this, and to make it clear to our so called health authorities we will not be subjected to being forced mRNA vaccines that reproduce in God knows where, parts of our body.

How those who administered the Covid 19 mRNA vaccine program can lie straight in bed at night in view of the thousands of people who died since 2020 and those currently dying from compromised immune systems is beyond me? Absolutely agree…I found myself telling my husband this evening that I would take voluntary euthanasia over a jab. This is because I am autoimmune resulting from a different vaccine that ruined my career, ruined my health and I will never get another.
