The Government has announced plans to amend the Policing Act to reaffirm police powers to collect and retain images in public places, a move critics warn could push New Zealand toward becoming a “surveillance state.”
Police Minister Mark Mitchell said the amendments would restore police’s ability to gather intelligence, prevent crime, and manage disorder, following court rulings that created uncertainty around photographing and recording in public spaces. The changes will also expand police powers to temporarily close areas in response to antisocial behaviour or public safety risks, including authority to direct individuals to leave closed zones and issue infringement notices or arrests for non-compliance.
However, privacy experts argue the new powers go beyond restoring past rights.
Privacy Foundation chair Gehan Gunasekara told state-funded media the ability to photograph people “just in case” they commit a crime in future could lead to mass data retention and racial profiling, eroding trust among vulnerable communities. He warned such broad powers risk normalising surveillance and stifling protest. Police Association president Chris Cahill backed the move as “restoring commonsense,” saying it would give officers clarity after conflicting legal interpretations and reflect modern realities of CCTV use. He added that safeguards around data storage and oversight by the Privacy Commissioner would be essential to balance policing needs with civil liberties.

Two years later this same person (Secret Service) showed-up at my apartment with his crony. I recognised both from the earlier encounters
