Judge declines Liz Gunn’s application for a discharge without conviction

Campaigner Liz Gunn was convicted of assaulting an Auckland Airport security worker in February 2023.

Gunn’s application for a discharge without conviction was heard today in the Manukau District Court.

Judge Janey Forrest ruled the conviction was proportionate to the offending.

While the judge acknowledged the assault was minor, she ruled the circumstances warranted the entering of a conviction. An application for costs by the prosecution was declined.

    The courtroom was charged with tension as Judge Janey Forrest announced Gunn’s conviction, according to state media. Emotions ran high throughout the trial, particularly when Judge Forrest exited the courtroom, prompting shouts of “There goes the corrupt judge, shame on you” and “what a joke” from some supporters.
    What a disgrace.

    • What is a disgrace is giving someone a criminal charge for touching someone on their shoulder.

      So much for a justice system. Shame on the police and the judiciary for allowing this ridiculous case to progress this far and for not demanding ALL the video footage be retained and provided to all parties.

      Shame on all involved. No conscience, no morals. This country has departed from all common sense and fairness. 😡

  6. The nation has ruled Judge Janey Forrest is a deep state appeaser and her ruling in this matter will be considered unjust by the people. It will be the shame she will have to live with for the rest of her career. Sneered at by people in public until she can’t go out.

    One day, when the just people rule, Liz Gunn will receive her pardon and honers. In the meantime, she will remain our beloved lady of New Zealand and a guardian of truth.

    • If Janey Forrest wanders into your place of business, you have the right to tell her that you will not trade with her and to get out. Fill in a trespass notice and file it with the police. Deep state appeasers will not be tolerated.

  10. Touching of the arm is full cause to grant a discharge without conviction.

    Sentencing Act 2002

    106 Discharge without conviction

    (1) If a person who is charged with an offence is found guilty or pleads guilty, the court may discharge the offender without conviction, unless by any enactment applicable to the offence the court is required to impose a minimum sentence.

    (2) A discharge under this section is deemed to be an acquittal.

    (3) A court discharging an offender under this section may—
    (a) make an order for payment of costs or the restitution of any property; or
    (b) make any order for the payment of any sum that the court thinks fair and reasonable to compensate any person who, through, or by means of, the offence, has suffered—
    (i) loss of, or damage to, property; or
    (ii) emotional harm; or
    (iii) loss or damage consequential on any emotional or physical harm or loss of, or damage to, property:
    (c) make any order that the court is required to make on conviction.
    (3A) Sections 32 to 38A apply, with any necessary modifications, to an order under subsection (3)(b) as they apply to a sentence of reparation.
    (4) [Repealed]
    (5) Despite subsection (3)(b), the court must not order the payment of compensation in respect of any consequential loss or damage described in subsection (3)(b)(iii) for which compensation has been, or is to be, paid under the Accident Compensation Act 2001.
