Parliament bans permanent name suppression for sex offenders without victim consent

Parliament has unanimously passed the Victims of Sexual Violence Bill, which stops courts from granting permanent name suppression to adults convicted of sexual offences unless the victim consents.

The legislation also bans questioning children under 12 about consent in sexual abuse cases and ensures automatic name suppression for all victims of sexual crimes, including image-based offences.

Justice Minister Paul Goldsmith and Police Minister Mark Mitchell hailed the changes as long overdue, stating they refocus the justice system on victim needs and accountability for offenders.

While the legal profession raised concerns about limiting judicial discretion, all parties in the House supported the bill, though no Te Pāti Māori MPs were present for the vote.

  1. This is actually quite dangerous when politicians are not only defining laws but pre-define legal outcomes, too. In Australia, for example, they are in some cases setting minimum 5 year sentences for so called anti Semitic comments, ignoring individual circumstance and circumventing the role, of the judiciary. Classic road to hell or in this case tyranny, appearing to be paved with good intentions.

    The key problem here is by exposing the name of the perpetrator, you may also expose the victim, to those who know them, in the wider community. As for the victim deciding, they may be in no fit state to do so. This is partly why we have courts and a judiciary.

  3. Noting false complaints are practically never penalised. Please could we have a law that addresses that very common scenario.
