The Court of Appeal is set to consider an application from Brenton Tarrant to vacate his guilty pleas and stand trial over the 15 March 2019 incident in Christchurch.
In August 2020 he was sentenced to life imprisonment without parole.
His appeal, filed late, seeks to challenge both his convictions and sentence, with the court first deciding whether the appeal can proceed and whether his guilty pleas should be set aside based on claims he was unable to make rational decisions due to alleged prison conditions.
The week-long hearing starts on 10 February and will include evidence from Tarrant, be overseen by three Court of Appeal judges, and take place under heightened security, with limited courtroom access and delayed broadcast viewing for victims’ families.
If the application is granted, the case would return to the High Court for trial; if declined, a separate sentence appeal may be heard later. Tarrant is also expected to give evidence to the Coroners Court after approval from the High Court.
