
A youth worker who was awarded nearly $30,000 for unfair dismissal after pushing a teen at a South Auckland Oranga Tamariki residence has lost her case on appeal.
The Employment Court overturned the earlier ruling, finding the youth worker used excessive force against a teen who verbally abused her, and was therefore justifiably dismissed.
While the judge acknowledged Hill acted in self-defence, it was ruled the teen posed no actual threat.
Despite criticising flaws in Oranga Tamariki’s investigation, the court concluded dismissal was appropriate, voiding the earlier compensation order.
