The legal fallout from the COVID-19 pandemic is shifting from public health measures to intellectual property, with biotechnology firms Arbutus Biopharma and Genevant Sciences suing Pfizer and BioNTech over the lipid nanoparticle (LNP) technology used in the Comirnaty mRNA gene therapy, marketed to the public as a “vaccine”.
The companies allege Pfizer used patented delivery technology without permission and are seeking damages, ongoing royalties and, in some jurisdictions, injunctions that could affect future sales.
Pfizer and BioNTech deny the allegations, and no court has ruled against them. The dispute follows Moderna’s agreement to settle similar litigation for up to $2.25 billion, highlighting the perceived commercial value of the controversial mRNA delivery technology.
Beyond the patent claims, the lawsuits have reignited broader debate over the balance between public investment, emergency pandemic powers, corporate profits, transparency and accountability, while critics argue many people who suffered vaccine-related injuries continue to face difficulties obtaining recognition, compensation and medical support.
