Lee Marsh, a manager at Birmingham City Council, has been found guilty of age discrimination for targeting a younger colleague by passing wind on him and making derogatory comments.

The employment tribunal heard that Marsh, who found his actions “amusing,” warned the younger caretaker, in his mid-thirties, that he could “get rid of you like I have the others in the past.”

Despite being recognised as a victim of discrimination, the younger worker will not receive damages due to a late claim but is eligible for compensation for unfair dismissal.

The court ruled that Marsh’s actions and comments displayed animosity and constituted age discrimination.
