NZ First leader Winston Peters has accused the Broadcasting Standards Authority (BSA) of “Soviet-era Stasi” censorship after the agency asserted jurisdiction over online broadcasters and podcasters, including Sean Plunket’s The Platform.
Peters called the move “blatant overreach” and demanded an explanation, while the Free Speech Union (FSU) described it as a “serious threat to free expression.” The controversy follows the BSA’s letter to The Platform, stating it could investigate a complaint about alleged racist comments aired on its July 22 programme, arguing the show meets the Broadcasting Act’s definition of a “broadcast.”
Plunket has rejected the BSA’s authority, claiming it acted outside its legal mandate and held a “secret kangaroo court” to expand its jurisdiction. He said the Act, written in 1989, only applies to traditional radio and television broadcasters, not internet platforms, and vowed not to participate in what he called a “bogus complaints process.”
The BSA defended its stance, with chief executive Stacey Wood saying the law’s definitions extend to all telecommunications, including digital platforms. She stressed the agency’s goal was not censorship but ensuring “freedom of expression and broadcasting without harm.”

Plunket treated Steve Kirsch combatively during their interview which challenges the idea that Plunket neutrally platformed both sides being clearly biased to the point of being obnoxious and overbearing
Plunket interrupted ridiculed and dismissed Kirsch’s data based on science
And used ad hominem tactics rather than engaging in a balanced debate attacking Kirsch’s integrity rather than from a perspective of a balanced argument
Plunket introduced Kirsch as a “leading anti-vaxxer and conspiracy theorist,” immediately setting a confrontational tone
Throughout the interview Plunket frequently talked over Kirsch challenged his credibility personally and refused to engage with the data Kirsch presented
Kirsch later justifiably accused Plunket of relying on “appeal to authority” tactics and avoiding substantive discussion
Social media responses described the exchange as a “train wreck,” with many criticizing Plunket for failing to conduct a fair or rational debate
Kirsch responded by challenging Plunket to a $1 million bet over vaccine safety claims, further escalating the dispute
Plunket weaponized the platform to reflect and distort reality

Precedent has been set by the UK where its version of the bsa (offcom) has no jurisdiction of the internet.
