A woman whose baby was stillborn in 2018 is pursuing $350,000 in damages from Health NZ Taranaki after the Health and Disability Commissioner (HDC) found her care during pregnancy was inadequate, particularly in the management of her type 1 diabetes.
She alleges the lack of coordination between obstetrics and diabetes services at Taranaki Base Hospital breached her rights under the Code of Health and Disability Services Consumers’ Rights, leaving her traumatised and unable to function normally.
Te Whatu Ora sought to have the claim struck out, arguing it went beyond the HDC’s findings and focused on the stillbirth rather than diabetes management. However, the Human Rights Review Tribunal dismissed the strike-out bid, ruling her claim had merit and could proceed to a full hearing.

That woman was knowingly taking a risk. Maybe she shouldn’t have bred. Why should society and the attached rort of ‘Health and Safety’ be forking out ‘damages’?

That woman has a certain amount of money extracted from her salary every month by the government (as do we all). When she spends her already taxed money on basic goods it is taxed again. When she buys anything from petrol to a house it is taxed again. And one day when she dies, whatever happens to be left over IS TAXED AGAIN before it even reaches her children/heir’s hands.
The social contract is supposed to be such that in exchange for being milked like tax cattle for our 50 odd productive years of life, we are promised things like a safe and secure country, jobs, food, shelter and healthcare.
If the government fails to provide these things to us they should be rightly sued and booed and shamed into oblivion, especially where their negligence causes the death of an unborn child.
Saying “her fault for breeding” is profoundly stupid and misses the point. Don’t excuse a shitty government’s bad behaviour.
