A US federal judge has thrown out the criminal cases against former FBI Director James Comey and New York Attorney General Letitia James, ruling that the prosecutor who secured their indictments had been unlawfully installed.
Judge Cameron McGowan Currie found that Lindsey Halligan — a former lawyer for President Donald Trump — was improperly appointed as interim US attorney for the Eastern District of Virginia, invalidating all actions stemming from her tenure, including both indictments.
In her order, Currie said Halligan’s appointment constituted “unlawful exercises of executive power,” rendering the charges void. Comey welcomed the ruling, calling the prosecution “malevolent and incompetent,” while James said she was “heartened” by the decision.
Trump has long accused both officials of targeting him politically, labelling the Russia investigation a “witch hunt” and claiming James pursued his business empire unfairly. Comey had been indicted in September for allegedly making false statements during a 2020 Senate hearing on the Russia probe, while James faced separate mortgage fraud charges in October.
According to CNN, the dismissal leaves open the possibility that the charges could be refiled with a lawfully appointed prosecutor. The White House insisted the indictments remain factually valid, disputing the court’s view that Halligan’s appointment was improper.
