U.S. Supreme Court blocks Trump’s global tariff powers

The U.S. Supreme Court has ruled that President Donald Trump overstepped his constitutional authority by imposing sweeping tariffs on countries around the world using emergency powers, striking down a cornerstone of his trade policy in a 6–3 decision.

The court found that Trump improperly relied on the 1977 International Emergency Economic Powers Act (IEEPA) to justify import taxes first targeting Canada, China and Mexico, before expanding them globally. Writing for the majority, Chief Justice John Roberts said the issue before the court was whether presidential authority to regulate imports under IEEPA included the power to impose tariffs, concluding that “it does not.”



The ruling reaffirmed that tariff-setting powers rest with Congress, despite Trump’s argument that drug trafficking and persistent trade deficits constituted national emergencies. Business groups welcomed the decision, with the US Chamber of Commerce calling it “welcome news for businesses and consumers,” while European trade officials described it as a “positive signal for the rule of law.”

In dissent, Justices Brett Kavanaugh, Samuel Alito and Clarence Thomas argued tariffs have historically been used to regulate imports, warning the ruling could create “serious practical consequences” for companies that had already paid the levies.

Following the decision, Trump ally Monica Crowley insisted the president still retained alternative trade powers, telling supporters, “President Trump has plenty of tools in the tariff toolbox… Don’t be a Panican! Trust Trump.”
