The U.S. Department of Justice is in negotiations to settle a $50 million damages claim filed by former national security adviser General Michael Flynn, Bloomberg reports.
Flynn, a close ally of Donald Trump, alleges he was targeted for political reasons during federal investigations tied to efforts to overturn the 2020 election.
According to court filings cited by the outlet, the settlement discussions represent a shift from the previous administration’s stance, which fought Flynn’s lawsuit in court.
Flynn argues that the government’s prosecution — part of wider federal scrutiny of Trump’s campaign, post-election challenges, and the January 6 ‘Capitol riot’ — was politically motivated. Trump and his supporters repeatedly alleged widespread fraud after losing to Joe Biden, claims so far dismissed by multiple courts.
The DOJ is also reportedly seeking to resolve a similar lawsuit brought by Stefan Passantino, a former senior White House lawyer who claims an election-related inquiry damaged his reputation through leaked confidential information. Unlike Flynn, Passantino has not publicly disclosed the compensation he is seeking.
Both men filed their lawsuits in 2023. Flynn lost the initial round of his case last year, while federal prosecutors continued defending the dismissal of Passantino’s suit well into mid-2025. Flynn originally pleaded guilty to lying to investigators about contacts with a Russian official but later withdrew the plea before being pardoned by Trump in late 2020.
Their claims come amid years of sprawling legal battles impacting numerous Trump associates involved in post-election disputes and January 6-related investigations, many of whom have also received pardons.
