Whistleblower nurse sues U.S. hospitals over alleged fetal death spike tied to COVID mRNA jabs

Registered nurse Michelle Spencer has filed a whistleblower lawsuit in Fresno County Superior Court alleging that Community Health System, which operates Community Medical Centers (CMC), concealed a dramatic rise in fetal deaths after COVID-19 vaccine policies were introduced in 2021 and retaliated against her for raising concerns.

The complaint, Spencer v. Community Health System (Case No. 25CECG03557) filed on 30 July, accuses the nonprofit health network of fraudulent concealment, unlawful retaliation, and unfair business practices. Filed by attorneys John W. Howard and Gregory J. Glaser and first reported by Brenda Baletti, Ph.D., at Children’s Health Defense, the 33-page filing claims that fetal deaths at Community Regional Medical Center rose from a baseline of one to two per month to about four per week beginning in spring 2021, corresponding with vaccination among pregnant patients. Spencer says internal discussions indicated nearly all demises involved vaccinated mothers. The suit cites a chart (p.8) by OB/GYN Dr. James A. Thorp, asserting a jump from a national average of roughly 5.7 stillbirths per 1,000 births before 2021 to 29.3 per 1,000 at one California facility after July 2021.

Spencer alleges the hospital publicly maintained that vaccines were “safe and effective” while suppressing contrary safety signals. After she leaked a September 2022 hospital-wide email titled “Record High Dead Babies” to media, she says she was denied a $5,000 bonus, removed from “good standing,” and issued a disciplinary warning based on what she calls a false HIPAA violation. Management, the suit claims, “gaslit” staff by suggesting alternate causes — including pesticides — while refusing to examine vaccine links.

The lawsuit further alleges systemic suppression of safety data, including failures to submit required adverse event reports to VAERS, falsification of death certificates to avoid implicating vaccines, and misleading the California Department of Public Health after Spencer complained, resulting in no investigation. The filing argues CMC protected contracts, reputation, and financial incentives — including participation in the CDC’s Vaccines for Children program and ties to UCSF Fresno — by withholding data from staff, regulators, and the public.

Spencer seeks compensatory and punitive damages, an independent audit of fetal death data, mandatory VAERS reporting of fetal demises, and a ban on coercive vaccine policies absent full informed consent. She also requests recovery of legal fees under California’s public-interest statute.

Community Health System, a locally owned nonprofit serving California’s Central Valley through Community Regional Medical Center and affiliated sites, says its mission is to deliver safe, high-quality care and reinvest surpluses into patient services and innovation. The health group had not filed a response in court at the time of the filing’s citation in the complaint.
