The Ontario Court of Appeal has dismissed a lawsuit against the Canadian government over the death of 17-year-old Sean Hartman following a COVID-19 vaccination, ruling the claim had “no reasonable prospect of success”.
The case, brought by his father Daniel Hartman, alleged federal officials were negligent in approving and promoting the Pfizer-BioNTech vaccine, but the court upheld an earlier decision to strike the claim in full. Judges found the government does not owe a private duty of care to individuals when making broad public health decisions during a pandemic, and said there was no evidence of bad faith or unlawful conduct by officials.
The court also ruled that public statements about vaccination did not create a specific legal obligation to the teenager. While acknowledging the death as a tragedy, the judges concluded the legal thresholds for negligence and misfeasance were not met and denied leave to amend the claim.
The appeal was dismissed without costs. Hartman says he is now considering taking the case to the Supreme Court, though he noted the financial burden involved.
