The Department of Corrections is seeking to impose an Extended Supervision Order (ESO) on David Aaron Stephenson (37), a member of the Filthy Few gang.
Corrections say he poses a very high risk of violent offending if he ‘becomes destabilised’.
The matter is being argued in the High Court at Hamilton.
Stephenson was released from prison five months ago after serving a full term for crimes including kidnapping, indecent assault, firearms, and methamphetamine offenses.
Corrections cited Stephenson’s history of violence, his use of meth to suppress emotions, and concerns about his mental health and untreated head injuries as reasons for the ESO.
According to a report in legacy media Stephenson put a gun to a woman’s head in a car and then fired it into the windscreen after she wouldn’t tell him where court witnesses involved in his earlier trial live. His abuse of the woman continued for hours, and including indecently assaulting her.
Stephenson’s lawyer argued he did not meet the threshold for an ESO, highlighting his engagement in rehabilitation programs and counseling while in prison, and questioning the assessment of his volatility.
ESO’s are a relatively rare measure, and are used to monitor and manage individuals who have been identified as posing a significant long-term risk of committing further serious sexual or violent offenses after they have served their sentence.
The court has yet to make a decision.
