The Government plans to change New Zealand’s climate laws to stop businesses from being held liable through the courts for damage allegedly caused by greenhouse gas emissions.
Justice Minister Paul Goldsmith said the move is designed to provide certainty for businesses amid ongoing High Court litigation against six major companies over their emissions. He said the case was creating uncertainty for investment and business confidence.
“The Government is acting now to provide legal clarity and certainty and to remove the possible development of a new regime that contradicts the framework Parliament has already enacted to respond to climate change,” said Goldsmith.
Under the proposed changes, the Government will amend the Climate Change Response Act 2002 to prevent courts from making findings of tort liability for climate change harm linked to greenhouse gas emissions, including in current and future proceedings.
Goldsmith said climate policy should continue to be managed through Parliament and existing national frameworks, including the Emissions Trading Scheme, rather than through “piece-meal litigation” in the courts.
“The courts are not the right place to resolve claims of harm from climate change, and tort law is not well-suited to respond to a problem like climate change which involves a range of complex environmental, economic and social factors,” said Goldsmith.
The minister said the changes would not affect the Government’s obligations under climate legislation and businesses covered by the ETS would still need to meet their emissions responsibilities.
