Christopher Sherborne, a 48-year-old Auckland charter boat captain, has been ordered to pay $4000 in reparation after a tragic incident during a staff party where a 25-year-old mother of two, Danielle Tamarua, fell into the Waitematā Harbour and died.
Sherborne, who was the skipper of the Zefiro, pleaded guilty to breaching the Maritime Transport Act by allowing unnecessary danger and operating without proper documentation. Tamarua, remembered as a talented young chef, fell overboard and was fatally injured by the boat’s propeller, which severed her left leg. Despite rescue efforts, she could not be revived.
Zefiro Charters Ltd, the company operating the vessel, faces a trial next month and could be fined up to $1.5 million if found guilty.
The incident highlighted safety lapses, including passengers being on the bow against the Maritime Transport Operation Plan and inadequate safety briefings.
Sherborne did not seek sentencing discounts and expressed remorse.
