A man who alleged he was discriminated against during a job application after discovering he had briefly dated one of the interviewers has had his claims struck out by the Human Rights Review Tribunal.
Pierre Ngog said the interview was unfairly terminated when the woman recognised him from two dates nearly eight years earlier and said she felt unsafe due to abusive messages he had sent at the time.
Ngog argued he was discriminated against because of both the prior relationship and his race, claiming the company relied on his follow-up email to portray him as violent.
The tribunal rejected both claims, finding the company’s decision was based on legitimate concerns for the interviewer’s safety and wellbeing rather than race or discrimination, and ruled the employer acted reasonably in not engaging further.
Ngog has indicated he is considering an appeal to the High Court.
