Real estate agents will no longer face automatic five-year disqualification from the profession for failing to complete continuing professional development (CPD) requirements or paying licensing fees late, following the passage of new legislation through Parliament.
The Regulatory Systems (Occupational Regulation) Amendment Bill and the Regulatory Systems (Tribunals) Amendment Bill both passed their final readings, introducing changes across eight Acts.
Associate Justice Minister Nicole McKee said the previous penalty was excessive and out of proportion with the offence, noting that no other regulated profession imposed such a lengthy ban for failing to meet CPD obligations.
McKee said the issue gained prominence through the case of real estate agent Janet Dickson, who risked being barred from practising for five years after declining to complete a compulsory CPD topic she believed was not relevant to her work. She added that she had also made it clear to the Real Estate Authority that CPD requirements should be directly relevant to the day-to-day work of agents.
The legislation also expands the ability of conveyancers to carry out conveyancing work, a move the Government says will increase competition in the property sector and provide consumers with greater choice. McKee said the change had received strong backing from the conveyancing profession.
Separately, the Regulatory Systems (Tribunals) Amendment Bill introduces changes to the Disputes Tribunal, allowing successful claimants to recover filing fees from respondents in appropriate cases. McKee said the reform was intended to ensure people pursuing legitimate claims were not left out of pocket simply for seeking justice.
The Government says the reforms form part of its broader programme to modernise regulation and improve access to the justice system.

CPD in this industry is necessary because parliament and local authorities are constantly changing laws and regulations. Higher court decisions change the law too. Those changes need to be shared amongst our members so they don’t put their clients in harms way.
For the record, Janet holds full Agent class licence. I think 30 years plus, with an unblemished record. The CPD for that year included video education on how the europeans stole Maori land. Apart from being misleading, that bit nothing to do with our profession. There are 2 acts that regulate iwi land. Sales. Essentially iwi have to approve a sale. In the video, they even got that wrong. The video said, iwi must approve the offer first. That was incorrect. The owner and solicitor are first.
The training should have been an option for those who work in that field. Regarless anything with Iwi on the title would automatically raise concern and further assistant from solicitors is necessary . Leaving me to wonder if iwi wants to be paid for their services.
As I understand this course netted some $6 million for the hour or so video. I want my money back.

I second that Janet should receive compensation and public apologies in the NZH and on NZStiffed, so the normies have to read it. This has been a tribal ruse, and we must continue to stamp it out.
We simply can’t have a person who has put her brand of inclusiveness running the REAA. We agents aren’t in the business of personal belief or race ideology. We are in the business of making sure our clients and the buyes are fully informed about the process, product, procedures and risks. To create buyer competition.
The head of police is a policeman.
The head of the fire department is a fireman.
The head of the government is a politician.
All people who have sufficient knowledge how that business functions.
The head of the REAA is bureaucrat who has next to zero experience and knowledge about what education is essential and what isn’t.
Educating us about maori gods and what their names are, isn’t. Only an agent with a couple of decades of experience covering all aspects of process, managing a sizeable real, estate company and its compliance is capable enough to administer the REAA.
Nicole needs to replace Belinda with someone who can bring their expertise and practical solutions to protect consumers. Anything less is make believe and guessing.

I’ve got nothing against people keeping up with technology and legislation etc., but scheduled “education” is intended to do something entirely different – not to mention it perpetuate the scams run by the “education” industry.
