
Veteran Air New Zealand pilot Captain Garth McGearty has won an Employment Court case against the airline after claiming he was unlawfully discriminated against because of his age.
McGearty, who turned 65 in 2017 while serving as a Boeing 777 captain, was placed on leave without pay after refusing to transfer to the lower-paid A320 fleet, a move he said breached his collective agreement and unfairly disadvantaged him.
The court found Air New Zealand’s actions unjustified, ruling that the airline failed to make reasonable adjustments to allow him to continue flying without causing significant disruption. Judge Kathryn Beck said McGearty was discriminated against due to age, and the decision to place him on unpaid leave was unlawful. Remedies will be determined if the parties cannot reach an agreement.

Airlines bitch about pilot shortages, but there are MANY ex-professional pilots in NZ who hold overseas certificates / licences, but the money and cost to convert over to a NZ License / ratings is prohibitive.
