Auckland businessman Mark Graham has spent five years battling to recover $11,500 mistakenly transferred to the wrong bank account due to a post-concussion error.
After ASB initially withheld the recipient’s identity citing privacy laws, Graham hired private investigators, pursued multiple Disputes Tribunal cases, and finally identified Zara Abrahall, who claimed she thought the funds were inheritance.
Though tribunal rulings eventually ordered repayment, Graham has yet to receive any money and is now using debt collectors.
His case, reported in legacy media (paywalled) highlights serious shortcomings in New Zealand’s legal protections for victims of accidental bank transfers, with police refusing to prosecute and banks constrained by privacy rules. Graham is calling for urgent law reform, pointing to stronger protections in countries like the UK where keeping misdirected funds can constitute a criminal offence.
