A US judge has dismissed involuntary manslaughter charges against Alec Baldwin after his legal team argued that crucial evidence regarding the live round that killed “Rust” cinematographer Halyna Hutchins was concealed by police.
Judge Mary Marlowe Sommer made the ruling shortly after the trial began in New Mexico, siding with Baldwin’s defense that the Santa Fe sheriff’s office mishandled evidence.
Baldwin’s lawyers contended that live rounds in the case were not properly recorded or disclosed, pointing to Seth Kenney, the film’s prop supplier, as the source of the fatal bullet. Kenney, who denied supplying live ammunition and faced no charges, was expected to testify against Baldwin.
The controversy centred around Colt .45 rounds submitted to the Santa Fe County Sheriff’s Office by Troy Teske, linked to “Rust” armourer Hannah Gutierrez’s stepfather, on the same day Gutierrez was convicted of involuntary manslaughter for Hutchins’ death.
Sheriff’s Office technician Marissa Poppel testified that the rounds were filed under a different case number, contradicting claims they were hidden.
Prosecutors argued that the evidence was not concealed and accused Gutierrez of bringing live rounds onto the set, which she denied.
Baldwin’s defense argued that the actor was let down by those responsible for on-set safety and that law enforcement focused more on prosecuting Baldwin than identifying the source of the live round.
