The Health and Disability Commissioner has found a GP breached a pregnant woman’s rights after discussing her request for an abortion in a busy clinic waiting area and failing to make a timely referral.
The woman, an international student with limited English, sought help during the 2021 Covid-19 lockdowns but was left distressed when sensitive details were discussed at the reception desk and she was later advised to wait until lockdown ended for a second appointment.
Deputy Commissioner Vanessa Caldwell said the doctor did not provide services with reasonable care and skill, criticising both the lack of privacy and delays in referral for what was a time-critical and highly sensitive matter.
The doctor acknowledged taking the woman to reception and informing staff she required a termination referral, but said this was intended to help coordinate next steps.
Caldwell said alternative, more private options should have been used and noted the GP also gave incorrect advice that termination services were unavailable during Level 4 lockdown.
While recognising the pressures of the pandemic, the commissioner said the delay potentially undermined the woman’s autonomy and could have been avoided with a simple inquiry or remote consultation.
The HDC has recommended the doctor undertake privacy training, apologise to the woman, and that the clinic review its complaints processes to ensure compliance with the Code of Health and Disability Services Consumers’ Rights.

Thats how long it takes the Health and Disability Commissioner to assess some simple facts, come to a conclusion, and recommend some additional training.
