The U.S. Supreme Court has approved the government’s right to require that passports list a holder’s sex as recorded at birth, marking a key victory for President Donald Trump’s administration in its effort to reverse policies recognising “nonbinary gender identities”.
In a decision released on Thursday, the Court ruled that displaying a person’s biological sex “no more offends equal protection principles than displaying their country of birth,” describing it as a “statement of historical fact” rather than discrimination. The order temporarily allows enforcement of the rule while ongoing legal challenges continue.
The ruling reinstates a policy introduced through Trump’s January executive order, ‘Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government’. The order requires all federal identification documents, including passports, to use biological sex and eliminates the nonbinary “X” marker option introduced under the Biden administration in 2021.
Critics have condemned the move as harmful to transgender and nonbinary Americans, arguing it could lead to harassment and safety risks. Supporters, including Attorney General Pam Bondi and Secretary of State Marco Rubio, praised the Court’s action as a “victory for common sense” and a step toward restoring what they call “biological accuracy” in federal documentation.
